Nebraska Law & Hit & Run Accidents

Nebraska Revised Statute 60-697 requires any driver involved in a crash causing injury or death to stop immediately, provide their name, address, and license number, and render reasonable assistance to injured parties. Leaving the scene under those circumstances is a criminal offense.

When injury or death is involved, the charge rises to a felony. A hit and run resulting in injury is a Class IIIA felony, carrying up to three years in prison. If the accident results in serious bodily injury or death, the offense escalates to a Class III felony, carrying up to four years in prison.

A criminal conviction of the fleeing driver is meaningful, but it doesn’t pay your medical bills or replace your lost income. Injured victims must pursue separate civil legal action to recover compensation.

Uninsured Motorist Coverage as the Primary Recovery Path

When the at-fault driver is never identified, Nebraska Revised Statute 44-6408 requires all Nebraska drivers to carry uninsured motorist (UM) coverage for bodily injury, making your own UM policy the primary route to compensation. Nebraska operates under an at-fault insurance system, so when the hit and run driver is identified, their insurer becomes the primary source of compensation, and a direct civil lawsuit against the driver is also available.

The Four-Year Filing Deadline

Nebraska Revised Statute 25-207 sets a four-year statute of limitations for personal injury claims, running from the date of the accident. Missing that deadline forfeits the right to recover. Evidence degrades long before then: surveillance footage gets overwritten, witnesses’ memories fade, and physical road evidence disappears. Early attorney involvement can preserve what matters.
